The “Vestel Smart Life” software application (“Application”) has been designed by Vestel Ticaret Anonim Şirketi (“Vestel”, “We”, “Our”, Us”, or “Company”) for the purpose of enabling control and remote monitoring of smart appliances including but not limited to Wi-Fi Technology Refrigerator, Washing Machine, Dishwasher, Oven, Air Conditioner, Robot Vacuum Cleaner, Air Cleaner, Smart Socket, Smart Bulb, Camera, Doorbell, Refined Purification Device, Electric Vehicle Charger Station  and TV (“Appliance”). The objective of the Privacy Policy (“Policy”) to outline the terms and conditions pertaining to the handling of data shared by the users (“User(s)”) during account creation or acquired from the Appliance during the usage of the Application.

We place the highest priority on personal data security. In line with this commitment, the processing of your personal data is carried out in strict compliance with the General Data Protection Regulation (“GDPR”), the Turkish Personal Data Protection Law No. 6698 (“TDPL”), and the local legislation in your country of residence.

If you are a resident of the European Economic Area (EEA) or if your personal data is processed as part of activities within the EEA, the GDPR applies to the processing of your personal data. Similarly, if you are a Turkish citizen or if your personal data is processed in Turkey, the processing of your personal data is subject to the TDPL.

Within the context of this Policy, the term "Personal Data" refers to any piece of information that can be used, either directly or indirectly, to identify you on a personal level.

If you have any questions about this Policy or your personal data, you can contact Us using the details in the "Contact Information" section. Upon contacting Us, your personal data will be processed to efficiently address your request and any subsequent queries. Once your request is resolved, pertinent data will be duly erased.

Please note that this Policy may be revised from time to time, typically when new features are introduced or updates to the Application are made. You can access the updated Policy via the Application.

Additionally, Vestel Holland B.V. Germany Branch Office is the data controller only for the membership creation processes on websites and applications managed by the respective company.   1. PERSONAL DATA COLLECTED
  1. Directly Provided Personal Data: This includes the information you give us when you register with the Application, such as your Name, Surname, Phone Number, Address, E-mail, Password, and User’s photo/image uploaded as an Appliance’s icon , Information about the user’s registered products and their warranty periods.
  2. Appliance-Connected Personal Data: This covers the information provided by the Appliance that you connect to through our Application, including MAC ID, User ID, Device ID,  Hardware Model, Model Name, Other Identifiers regarding the Appliance (including its settings), User's Actions on the Appliance (including usage time or the number of clicks), Status of Live Support Service Utilization and Energy Consumption (including water consumption).

The personal data of users is exclusively collected from the Application and the Appliance.

  1. THE PURPOSE OF COLLECTING PERSONAL DATA AND LEGAL BASIS

We as well as our service providers process your personal data we have collected or been provided with for the following purposes:

  1. Creating and managing accounts, as well as updating information.
  1. Carrying out information verification procedures.
  1. Contacting you regarding assistance, maintenance, or other services Vestel provides for your Appliance.
  1. Ensuring that your phone is connected to your Appliance, allowing you to monitor and control your Appliance from anywhere, and enabling you to use the services provided by the Application.
  1. Ensuring Users satisfaction and responding to complaints and requests from Users.
  1. Improving the Appliance usage experience of the User, developing the services and creating new services.
  1. Making statistical evaluations and creating a database to ensure the Application and product development and to carry out commercial activities.
  1. As part of our customer satisfaction initiatives, we aim to gather your inquiries related to predefined and categorized topics (such as purchase orders, assembly, membership, or promotional campaigns) before you contact us. This allows us to offer responses that are tailored to your needs. Also, we will maintain a record of your conversation history to facilitate your access to information and make it easier for you to find answers to your questions.

  1. CREATING A USER ACCOUNT ON ALL PLATFORMS

When you create a membership on any of Vestel's websites (vestel.com.tr; regal-tr.com; vsoutlet.com.tr; cozumuvar.vestel.com.tr) or through Vestel’s applications (Vestel Smart Life Application; Vfit+ Application), you can use the same membership credentials to access all these platforms.

If your membership is terminated, either automatically or by your request, it will be concurrently revoked across all platforms.

Please note that all platforms where membership is available are owned by Vestel. Membership is exclusive to Vestel-owned channels; thus, it is not possible to register on channels outside of Vestel’s network. Moreover, we do not share your data with third parties for membership.

  1.  CREATING GLOBAL MEMBERSHIP

Improving and facilitating the customer experience is one of Vestel's highest priorities. In this regard, Vestel operates a shared account policy across all its companies. Accordingly, if a membership is created through a website or application managed by Vestel in any country, the same membership information can easily be used to log in to websites or applications in other countries.

It should be noted that only the membership information listed above is shared among Vestel companies. No other information is shared

  1. PROCESSING IP ADDRESS INFORMATION OF THE USERS

Vestel may determine and use the User's IP address when required to detect the issues regarding the Appliance or the Application and settle them. IP addresses may also be used to identify the User in a general way and to collect comprehensive demographic information.

  1. PROCESSING LOCATION INFORMATION OF THE USERS

If the Users approve, the location information of the Users is processed by Vestel for the following purposes:

  1. Obtaining address information so that you can use the nearest authorized service in case of a malfunction of your Appliance,
  1. During the installation process of your Appliance, the wifi SSID information is required for your Appliance to be controlled remotely by connecting over the internet, so that you can easily select by listing the nearest wifi devices.

You can easily stop the Application from accessing your location by going to the location services settings on your phone.

  1. PROCESSING PERSONAL DATA FOR PROFILING ACTIVITIES 

We offer users the option to share additional personal information, such as preferences, interests, and demographics in order to create personalized profiles and analyze User interactions. This allows us to tailor our services to their individual needs and improve their overall experience. The types of personal data that may be collected with user consent are outlined below:

These personal data may be provided to our Company at the following stages:

(i) During Account Creation:
When you register for the first time, you will be presented with an option to “Complete Your Profile” after providing consent for marketing purposes. This step allows you to voluntarily provide the following additional personal data:

(ii) Updating an Existing Profile
Users who already have an account will be given the option to complete their profile by adding this new information through an update. This option will appear in your profile under “Complete Additional Information.

(iii) Flexibility to Edit or Update Information

You can enter, update, or change the additional information at any time by accessing the “Complete Profile” section in your user account.

  1. Voluntary Provision of Data:

Completing this additional information is entirely voluntary. Users are not obligated to provide this data to continue using the Application or core services.

If you prefer not to complete your profile and don't want to share this information, your Application experience will stay the same. We won't collect any extra data.

  1. How Data Will Be Used 
  1. Direct Marketing

We process your personal data, including the information you provide when completing your profile, to send you marketing communications. These communications may include general or personalized promotions, discounts, sales, advertisements, deals, and special offers from our Company and our business partners, and may be sent to you via email, SMS, phone, push notifications, and WhatsApp, subject to your consent.

We also use your personal data to create a profile that helps us customize our marketing communications based on your interests, preferences, and interactions with our services and usage patterns. 

Additionally, we may invite you to participate in surveys or activities to measure customer satisfaction and improve our services.

  1.  Profiling for New Projects and Services

Your personal data, including the information you provide when completing your profile, may also be used to analyze customer preferences and behavior. This includes analyzing preferences, behaviors, and trends to identify customer needs and to develop and improve products, services, and projects tailored to different user segments.

  1. Legal Basis 

Your explicit consent is required for the processing of this data (Art. 6 (1) lit. a GDPR; Art. 5 (1) TDPL).

During the registration process or profile updates, you will be explicitly asked to provide your consent for the collection and processing of this additional personal data for marketing and user profiling purposes.

At any time, you can withdraw your consent by adjusting your preferences in the "Settings" section or contacting us directly. When your consent for data processing is withdrawn, your personal data will no longer be processed for the purposes stated in this section and will be deleted in accordance with Our data retention policy.

  1. PROCESSING OF PERSONAL DATA IN THE CASE OF CREATING A FAMILY ACCOUNT

The Application enables the creation of a family account so that a user in the position of owner ("Owner") can create a virtual home, embed her/his Appliance into the created virtual home, and create members who can control and access the Appliance. The Owner can monitor the members' activities, whereas members cannot access one another's personal information.

The Owner’s name, the name and of the virtual home, the name and ID information of the rooms, the information of the Appliances already embedded to the virtual home, current Appliance status and services information of the Appliances such as EasyBill information, notifications of the Appliances such as the food in the oven is cooked) of the Owner will be processed and shared with the members.

The members’ name and the ID information of the members will be processed and shared with the Owner for the purpose of monitoring the members’ activities.

  1. PROCESSING YOUR PERSONAL DATA WITHIN THE SCOPE OF SUPPORT FEATURE

Our Company strives to address any issues quickly and effectively you encounter while using the Application or Appliance. If you contact us through the user support section, We will promptly evaluate the problem and provide all necessary assistance to ensure your satisfaction.

To solve your complaints and improve customer satisfaction, We will process the information you provide in the support section, including your account information such as name, surname, email address, country and Appliance related information such as Serial Number, User ID and MAC ID and details about the problem you are experiencing and an image of malfunction.

If your issue requires technical support, We may need to share your personal data with third parties from whom we get service for this purpose, including your name, surname, address, and phone number. This is necessary only in cases where on-site intervention is required, and this process is done with the greatest of caution to protect your privacy and security.

  1. PROCESSING OF YOUR PERSONAL DATA WITHIN THE SCOPE OF MAKE A SUGGESTION FEATURE

The make a suggestion feature was created solely to identify the Appliance issues. Your specified personal information will only be used for product development, and you will not receive any feedback regarding the suggestion you encountered.

In this regard, your personal information, including information about your Appliances (Device ID, MAC ID, Local IP, Software Version, Model), will be processed and transferred to hosting providers.

  1. PROCESSING PERSONAL DATA WITHIN VASSISTANT AND VCHEF FEATURE
  1. Vassistant:

We offer you an artificial intelligence-enhanced chat environment that allows you to answer any questions you have about your appliance connected to the application. Our system carefully goes over the user manual when you submit a question, and it will quickly provide you with clear information to help address your concerns. Within this service, we do not store your conversation history.

  1. Vchef: 

Within the scope of this service, we offer you an artificial intelligence-enhanced chat environment that can only talk about food. You will be able to get recipes to use your appliance, as well as find answers to your questions about recipes and foods. In addition, you can upload photos of your food, and the chatbot will generate suggestions based on the items visible in the photos. The AI only provides answers based on pre-existing data and does not learn from your interactions or train itself based on your usage.

Also, Vchef allows you to create shopping lists using the chatbot and share them with members of your virtual home (members of the owner), as explained in Article 2.5. This feature enables collaborative planning and enhances your experience within the Application.Only the family members or the owner you designate within your virtual home can access your shopping lists. You have full control over who can access your shopping lists.

When you use our services, we will process your personal data for the following purposes:

  1. Personal data collected through Vassistant and Vchef: 

To use these services, you must be logged in with an application membership. In this regard, in addition to the personal data stated in Section 1, the following information will be processed within the scope of the conversation you have conducted:

User Content: When you use our service, we collect personal data that is included in the input, file uploads (such as food photos), or feedback that you provide to our service.

Communication Information: This includes prompts and generated content. Prompts are submitted by the user, and content is generated by the service, including completions, chat completions, images, embedding operations, items added to your shopping list,  usernames or identifiers of family members with whom you share the shopping list.

Aggregate or Anonymous Information: To remove any identifying details, we combine or anonymize personal data, allowing us to analyze the performance of our services and enhance their functionality.

  1. Data minimization and purpose limitation within Vassistant and Vchef:

We only collect and process the minimum amount of personal data necessary to provide Vassistant and Vchef services. Your personal data will only be used for the purposes explicitly mentioned above and will not be repurposed for other uses without obtaining your additional consent.

  1. Sharing data with third parties within Vassistant and Vchef:

The information you disclose during your conversations may be shared with third parties who provide services to us for the purpose of delivering the relevant service to you. These third parties are bound by contractual agreements to comply with TDPL, and they will not use the information you provide to enhance or train their own products or any third-party products.

  1. Legal Basis for Processing:

To access the services provided by Vassistant and Vchef, your explicit consent is required, as per Art. 6 (1) lit. f GDPR; Art. 5 (2) lit. f TDPL. This ensures that you have a clear intention to benefit from these services and have been fully informed of the processing activities involved.

  1. No Automated Decision-Making or Profiling:

The AI systems involved in Vassistant and Vchef do not engage in any profiling or automated decision-making processes that could affect your rights or freedoms. These systems only process data as per the inputs you provide and respond based on pre-trained data sets without altering their behavior based on individual interactions.

  1.  AI-Specific Transparency (AI Act Compliance):

We are committed to ensuring transparency in our use of artificial intelligence. The AI systems used in Vassistant and Vchef provide automated responses based on the data and instructions they have been programmed with, and they do not self-train or improve based on user interactions. This ensures that your personal data is not used for AI training or machine learning purposes. 

We implement appropriate security measures, including encryption and secure communication protocols, to protect the personal data processed through Vassistant and Vchef from unauthorized access or disclosure.

You have the right to access, rectify, or delete the personal data processed through Vassistant and Vchef. If you wish to exercise these rights, please contact us through the channels mentioned in Article 7 of this Policy. 

  1. USING GOOGLE ASSISTANT WITH VESTEL SMART LIFE

If you choose to use the Google Assistant service with the Application, certain data will be shared with Google to enable this feature. This functionality allows you to control your Appliances via voice commands using Google Assistant.

To enable communication between your Appliances and Google Assistant, the following data will be shared with Google:

No other personal data (e.g., name, email address, or appliance usage data) is shared with Google for this integration. Also, We  do not receive or process the audio.The User ID and Device ID are shared solely for the purpose of ensuring that your connected Appliances can recognize and execute commands received via Google Assistant.

You may withdraw your consent at any time by opening Google Home app, navigating to “Settings > Works with Google”, finding our app under “Linked Services”, and selecting the Unlink Account button option, and disabling the integration.

When you choose to use the Google Assistant service with our application, please note that Google is solely responsible for all data processing activities conducted within the Google Assistant service. As such, Google acts as an independent data controller for any data it receives through the Google Assistant.

  1. SERVİCES PROVIDED BUSINESS PARTNERS 

Depending on Vestel's business partnership within the scope of the Application, various additional services may be offered to Users (for example, setting the Appliance according to the pre-determined cooking time according to the recipes).

In this case, if the Users want to use the services provided by our business partners, their MAC ID, Device ID, Version, Brand Feature, or Energy and Consumption information can be processed and transferred to the relevant business partners for the purpose of integration with the Appliance and ensuring that consumers receive the service provided. 

  1. PARTIES TO WHOM PERSONAL DATA IS TRANSFERRED

Your personal data will be shared only with the following persons and for the following purposes:

 

We may share anonymous data with Vestel Group companies without disclosing your identity for the development of customer, product, and service evaluations and analyses and the performance of various statistical evaluations. After the anonymization of such details and information, Vestel Group companies may also use the same for all kinds of income generating activities.

Vestel processes the personal data for as long as it is necessary to achieve the intended purposes pursuant to Section 2 above. The personal data collected for the purposes of Section 2, will be retained for the period strictly necessary to respond to data subjects' requests and pursue Vestel business interests and comply with applicable laws and regulations

  1. RIGHTS OF DATA SUBJECTS

You have the following rights against us:

  1. Right of access

 You have the right to access as to whether and, if so, what your personal data of you are being processed by us. Is this the case, we will additionally give you access to the following:

 (1) the purposes of the processing.

 (2) the categories of personal data concerned.

 (3) the recipients or categories of recipients of your personal data.

 (4) the envisaged period of storage or the criteria used to determine the envisaged period of storage.

 (5) any other rights you have.

 (6) where we have not obtained the personal data from you: any available information as to their source.

 (7) if available: the existence of automated decision-making and any information about the logic involved, as well as the significance and the envisaged consequences of the processing.

  1.  Right to rectification

 You have the right to rectification and/or completion of the personal data that is being processed by us, if it is inaccurate or incomplete.

  1.  Right to restriction of processing 

 You have the right to restriction of processing of your personal data, provided that.

 (1) we verify the accuracy of your personal data being processed by us.

 (2) the processing of your personal data is unlawful.

 (3) you need the personal data being processed by us for the purpose of prosecution when we no longer need your personal data for the purpose of processing.

 (4) you have objected to the processing of your personal data, and we are in the process of verifying your objection.

  1.  Right to erasure

 You have the right to erasure of your personal data, provided that.

 (1) we no longer need your personal data for its original purpose.

 (2) you withdraw your consent and there is no other legal ground for processing your personal data;

 (3) you object to the processing of your personal data and, unless it is about direct marketing, there are no overriding grounds for further processing;

 (4) the processing of your personal data is unlawful;

 (5) the erasure of your personal data is required by law;

 (6) your personal data have been collected in relation to the offer of information society services when you were a minor.

  1.  Right to notification

 If you have asserted your right to rectification, erasure of data or restriction of processing, we will communicate any rectification, erasure of data or restriction of processing to any recipients of your personal data.

  1.  Right to data portability

 You have the right to receive your personal data processed by us on the basis of your consent or for the performance of a contract in a structured, commonly used and machine-readable format as well as to transmit them to another controller. If it is technically feasible, you have the right to have them directly transmitted from us to another controller.

  1.  Right to object

 You have the right to object to the processing of your personal data on particular grounds. If this is the case, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing.

 If your personal data is being processed for the purpose of direct marketing, you have the right to object at any time.

 You have the right to withdraw your consent given to us at any time. The withdrawal of the consent does not affect the lawfulness of the processing carried out based on the consent before your withdrawal.

You have the right to file complaints with the appropriate authorities. To do so, you can contact the relevant data protection authority in your city or region.
